The Constitutional Window

The record

Neither the U.S. Constitution nor the Texas Constitution contains a 'window' that closes on election night.

Counting and canvassing continue after election day according to fixed statutory timelines. In Texas, local canvasses generally occur between the third and eleventh day after the election, and the state canvass occurs between the 15th and 30th day (Election Code Secs. 67.003 and 67.012). Invented deadlines are a standard urgency device. They turn a routine process into a countdown.
